Selling a junk car in Westfield

Some downtown Westfield streets give a car two hours a day. Elm Street's easterly side for 150 feet south of Bartlett Street, part of Westminster Street, and White Street between Cherry and Main are on the list. A dead car cannot leave when time runs out. We buy whole non-running and junk cars, so you can sell the whole car as it sits, with free pickup anywhere in the US, Westfield included.

Westfield's parking sections

Section 17-117 opens: "No person shall allow a vehicle registered in his name to be parked more than two hours of any day" on the streets it names. Section 17-130 puts the same two-hour cap on a city off-street lot during set daytime and evening hours. The wording points at the registered owner. A Westfield car you stopped driving still counts against you while it carries your registration.

The code sections we checked had no Westfield ordinance about junk cars on private property. The city may have one, so ask City Hall before you assume the yard is safe.

State law fills the gap

Massachusetts chapter 90, section 22C works in every town. Westfield officers can remove a car as refuse when three things are true. It seems abandoned. The Westfield car sat past 72 hours on a street, or on land where the owner never gave the OK. Removing it costs more than it's worth. For private property, the RMV's automobile-law page refers residents to local police guides, since bylaws are set town by town.

Replacing the car within a week

Massachusetts plates follow the owner. Drivers 18 or older get 7 calendar days, counted from when the old car is gone, to bolt the plates onto its replacement. No temporary plate exists to bridge a longer gap; the Registry of Motor Vehicles issues none.

No replacement coming? Then the registration ends online, the receipt goes in a folder with a copy to the insurer, and the Westfield plates get cut in two or recycled. They are not mailed back.

The title

Mileage first. Next, both people in the Westfield sale sign, print and date in the spots the title marks. If no price line appears on the title, a bill of sale carrying the price must go in. A notary is not part of the RMV's seller list. An old loan that still shows on the record calls for a letter from the lender, signed, on its letterhead; lien still on the title explains.

Questions people ask

Does Westfield have its own junk car ordinance?
Not in the code sections we read, which cover parking. Westfield could have other rules, so City Hall is worth a call. State law applies regardless.
I'm buying another car. Can my old plates go on it?
Yes. A Westfield owner 18 or older has 7 calendar days from parting with the old car to move the plates over. The RMV sells no temporary plates for extra time.
Who gets the ticket on a Westfield two-hour street?
Sections 17-117 and 17-130 are aimed at the registered owner: "No person shall allow a vehicle registered in his name to be parked" beyond the limit.
