Selling a dead or junk car in Ponca City

In Ponca City, a car doesn't need to be broken down to get cited. Under Section 8-1-16 it is unlawful to keep a motor vehicle "not bearing a current motor vehicle license tag or tags on any residential property," running or not. So a car you quit registering after it died can break two city rules at once. We buy whole non-running and junk cars. Sell the whole car as it sits, with free pickup anywhere in the US, Kay County included.

The tag rule and its ten days

The city building official enforces 8-1-16. Notice comes by certified mail, and you have "ten (10) days from the date of mailing such notice" to get the untagged vehicle off your premises or the street. After that the official files a complaint in municipal court. Time is counted from when the letter is mailed, not when you get it.

Only a few places may hold untagged cars: property of a licensed Oklahoma dealer, a junkyard that follows city ordinances, or a body and repair business.

Forty-eight hours for a dead car

Section 6-4-2 is the junk-car rule. No one may keep "a dismantled, junked, abandoned, unserviceable, wrecked, partially dismantled, inoperable" vehicle outdoors on any lot, city-owned or private, "for a period exceeding forty eight (48) hours," unless it is enclosed.

Under Section 6-4-4, the notice is handed to you or posted on the front door of the property. To fight it, apply in person at the municipal court clerk "within five (5) days of the posting or delivery of the notice, whichever is sooner." The hearing starts fresh, and the city must show "by clear and convincing evidence" that the car is a nuisance.

Not under the carport

Carports are allowed, but Section 11-5-1 says none may be used for "the parking and/or storage of inoperable vehicles." In Ponca City a carport roof does not shelter a dead car from the rule.

On the street

Section 8-5-11 caps any vehicle left "unattended and unmoved" on a street or other public place at 48 hours. Past that, Section 8-2-16 lets police tow it. The car comes back only after impound and storage costs are paid and the chief of police or a representative signs off on the release. Read towed or impounded if that bill tops the car.

A lapsed tag and the sale

Oklahoma expects every vehicle to be registered each year whether or not it is driven. When that slips, the state collects fees and penalties for this year plus one year back. The late penalty adds $1.00 per day once the month after the tag expired has ended, and it stops at $100. See tickets or registration hold.

When you sell, the plate stays in your name and is not transferable to the buyer; it can be switched onto your next vehicle if that one is in the same registration class. A notary must witness your title assignment. Service Oklahoma, which handles titles along with licensed tag agencies, needs the sale pre-registered by one of the two parties within 2 business days. After you sell has the rest.

Questions people ask

Is an expired tag alone a violation in Ponca City?
On residential property, yes. Section 8-1-16 makes it unlawful to keep any motor vehicle without a current license tag at a home, whether it runs or not. Once Ponca City's building official mails a certified letter, the owner has ten days from that date to get the car out.
Can a broken-down car sit under my carport?
No. Section 11-5-1 says no carport may be used for parking or storing inoperable vehicles. Section 6-4-2 allows 48 hours in the open unless the car is enclosed.
What are the steps to fight a Ponca City junk-vehicle notice?
Apply in person at the municipal court clerk within five days of the posting or delivery of the notice, whichever came first. At the hearing the city must prove its case by clear and convincing evidence.
