Selling a junk or dead car in Anderson

Anderson's code calls a car abandoned before it is dead. Section 42-62 defines an abandoned motor vehicle as one "in a state of disrepair and incapable of being moved under its own power or has no up-to-date inspection sticker or license tag." So a car that still starts, but carries an expired tag, fits the definition. If yours has been parked that long, we buy whole non-running and junk cars, and you sell the whole car as it sits.

The nuisance list in Section 42-62

The section puts cars in plain company. It is unlawful for "the owner, tenant or person in charge of any real property in the city" to let rubbish, scrap lumber, "old refrigerators, washing machines, clothes dryers, stoves, abandoned vehicles" and similar things pile up. Any such pile is "hereby declared to be a nuisance."

Two points follow from the wording:

  • Renters are named. Leasing an Anderson house does not push the problem onto the landlord, since the person in charge of the property is listed too.
  • Paperwork counts like the engine. A tagged car that will not move fits; so does a running one whose sticker or tag lapsed.

The sections in our Anderson brief show no notice period and no fine for this rule. Those rules may sit in another part of the code, so calling the city beats guessing at your deadline.

Downtown is a one-hour town

If the car quits on the way through downtown Anderson, the limits are short. Section 82-122 caps city-owned spaces at one hour on:

  • Main Street, from Market Street to Sharpe Street
  • Benson Street, from Main Street to McDuffie Street
  • Whitner Street, from Main Street to McDuffie Street

Section 82-121 sets two hours on the block of Main between Market and River. Drivers showing a disabled veteran tag or a handicapped tag or sticker get two hours in the one-hour spaces.

What state law adds in Anderson

In South Carolina the limit is two days on a highway, or one week on land that isn't yours when the owner hasn't said yes. The state also has a "derelict" class: among others, a car past eight years of age whose registration is not current. Officers, Anderson code staff included, can stick a colored tag on such a car as a warning. If it gets towed, both the wrecker and the lot holding it must mail the last registered owner, and any lender on the title, by certified or registered mail. Nobody claims it, and it can go to public auction.

Title, plate and the SCDMV

This page does not list an Anderson County SCDMV branch; the agency keeps its office list on dmv.sc.gov. On the back of an Anderson title, the first assignment takes the buyer's details, the lender if any, odometer, price, sale date and both signatures. Afterward, Form 416 tells the SCDMV the car is sold. The plate is not part of the sale. Use it on your next car or hand it back with Form 452, and stop the insurance.

A replacement title costs $15. When a bank still has a lien, the duplicate is mailed to the bank instead of you. See junk car with no title for older cars that may go without one.

Questions people ask

An Anderson car that still starts but has a lapsed tag: is that abandoned?
By the city's wording, yes. Section 42-62 counts a car that has "no up-to-date inspection sticker or license tag" as abandoned, and an abandoned vehicle left on land in the city is a nuisance.
Can I leave my dead car parked in downtown Anderson?
For an hour on Main between Market and Sharpe, and on Benson and Whitner between Main and McDuffie, under Section 82-122. The Main Street block from Market to River allows two hours.
When does South Carolina treat an Anderson car as abandoned?
South Carolina law treats an Anderson car as abandoned past two days alone on a highway, or past a week on someone else's land without their okay.
Does my Anderson plate go to the buyer?
No. A plate cannot move between people when the first person is not on the title. Keep it for another car titled to you or mail it back with Form 452.
